L’American Library Association (ALA) diffuse un sommaire des positions envoyées à la Cour concernant l’entente dans le recours collectif contre Google Books aux USA (pdf, EN, 1.3 Mo, 9p).

Ne manquez surtout pas le passage de Robert Darnton à l’Université Concordia à la fin du mois de mai 2010 lors du Congrès de la Fédération canadienne des sciences humaines. Robert Darnton est directeur de la bibliothèque de Harvard.
Aux premières heures du projet de numérisation de livres de Google, il en fut un des défenseurs, avant de faire un volte-face complet. D’ailleurs, nous vous suggérons son texte publié dans Le Monde Diplomatique en mars dernier : «La bibliothèque universelle, de Voltaire à Google» .

Décidément, il n’y a rien comme une date de tombée pour voir l’éclosion de positions sur le projet de numérisation Google Books. C’est au tour d’IFLA d’émettre sa position, l’association internationale du monde des bibliothèques.
L’IABD (Interassociation Archives Bibliothèques Documentation), qui réunit 17 associations professionnelles, diffuse une déclaration qui met en porte à faux le projet de numérisation du géant du Web Google.
Des intervenants se sont livrés à des audiences publiques concernant Google en Europe, selon Bloomberg. L’agence de nouvelle américaine relève les commentaires de plusieurs à propos du projet de numérisation de livres :
“We’re concerned about the monopolistic nature of the project,” Stuart Hamilton, senior policy adviser at the International Federation of Library Associations and Institutions, said at the hearing. “The immensity of the project and the fact that Google has a five-year lead makes it challenging for others to start viable, competing projects.”
L’organisation mondiale de la propriété intellectuelle (OMPI), en collaboration avec le ministère de la Culture d’Espagne, annonce la tenue d’une conférence gratuite les 29 et 30 octobre 2009 à Madrid, en Espagne. Ayant pour thème: « International Conference on Intellectual Property and Cultural Heritage in the Digital World » cet événement vise:
Recognizing the importance of these dual functions in a networked digital world, the perspective of the International Conference will be twofold. First it will concentrate on CHIs as users of IP, either directly or as facilitators of use by the public, in areas such as digital preservation and with regard to access and use under copyright limitations and exceptions. Second, the Conference will address the role of CHIs as rightowners and managers of IPRs, examining how information and communications technologies (ICTs) are being used to promote access to their collections and related digital content.
Ainsi, outre les avocats et les fonctionnaires, cet événement est d’intérêt pour les professionnels de l’information, les conservateurs de musées et les chercheurs.

Le Sismographe, le carnet culturel des journalistes du quotidien montréalais Le Devoir, rapporte le cas d’un internaute des USA qui a téléchargé près de 3000 photos du Musée national du portrait (MNP) au Royaume-Uni. Selon Wiki News,
he complaint by the NPG is that under UK law, its copyright in the photographs of its portraits is being violated. While the gallery has complained to the Wikimedia Foundation for a number of years, this is the first direct threat of legal action made against an actual uploader of images. In addition to the allegation that Coetzee had violated the NPG’s copyright, they also allege that Coetzee had, by uploading thousands of images in bulk, infringed the NPG’s database right, breached a contract with the NPG; and circumvented a copyright protection mechanism on the NPG’s web site.
The copyright protection mechanism referred to is Zoomify, a product of Zoomify, Inc. of Santa Cruz, California. NPG’s solicitors stated in their letter that « Our client used the Zoomify technology to protect our client’s copyright in the high resolution images. ». Zoomify Inc. states in the Zoomify support documentation that its product is intended to make copying of images « more difficult » by breaking the image into smaller pieces and disabling the option within many web browsers to click and save images, but that they « provide Zoomify as a viewing solution and not an image security system ».
In particular, Zoomify’s website comments that while « many customers — famous museums for example » use Zoomify, in their experience a « general consensus » seems to exist that most museums are concerned to make the images in their galleries accessible to the public, rather than prevent the public from accessing them or making copies; they observe that a desire to prevent high resolution images being distributed would also imply prohibiting the sale of any posters or production of high quality printed material that could be scanned and placed online.

Le bulletin d’information du Commissariat à la protection de la vie privée du Canada contient un article concernant les applications d’imagerie à l’échelle, comme le projet StreetView de Google :
« Le Commissariat comprend que ces sites soient populaires — ils donnent la chance d’explorer des destinations vacances et de vérifier des indications routières », affirme la commissaire adjointe à la protection de la vie privée, Elizabeth Denham. « Mais nous tenons aussi à ce que les Canadiennes et les Canadiens soient conscients des risques d’atteinte à la vie privée. »
